Nondiscrimination & Sexual Harassment Policy

marketumbrella.org and its Crescent City Farmers Market strive to ensure that all our transactions in the common meeting space we share are safe and transparent and that they exceed expectations for all participants. We work to ensure that no one is subjected to an environment that is hostile. It is our common responsibility to ensure a neutral and safe environment for all the community to share by providing an atmosphere free of discrimination and harassment of any kind. Our policy applies to market vendors, shoppers, the marketumbrella.org board of directors, and community advisory members.

marketumbrella.org and its Crescent City Farmers Market prohibits discrimination in all its programs and activities on the basis of race, color, creed, national origin, age, disability, gender, marital status, family status, religion, sexual orientation, veteran status, or socio-economic status including discrimination or harassment because all or part of an individual’s income is derived from any form of public assistance.

We prohibit harassment of any one employee or agent, Crescent City Farmers Market vendor, or market shopper by another employee, supervisor or third party including Crescent City Farmers Market vendors or shoppers for any reason including, but not limited to: race, religion, creed, gender, sexual orientation, veteran status, uniform service member status or any other protected class under federal, state or local law.

The purpose of this policy is not to regulate the personal morality of employees or agents, shoppers or vendors. It is to ensure that, no employee, vendor or shopper harasses another for any reason or in any manner. The conduct prohibited by this policy includes conduct in any form including verbal, non-verbal, and physical unwanted acts and not limited to e-mail, voicemail, chat rooms, Internet use or history, text messages, videos, pictures, images, writings, words or gestures.

While it is not easy to define precisely what harassment is, it includes: sexual innuendoes, lewd remarks, threats, slurs, epithets, derogatory comments or visual depictions, unwelcome jokes and teasing.

Anyone who feels that (s)he is a victim of such harassment should immediately report the matter to the Market Manager or Associate Director via telephone (504) 861-4488, email to markets@marketumbrella.org, hand-delivered written report at the market’s welcome booth, or by mail to marketumbrella.org’s offices 200 Broadway, Suite 107, New Orleans, LA 70118.

If an employee, market vendor or shopper feels that (s)he is a victim of harassment by the above management member, or (s)he makes a report and the above management member either does not respond or does not respond in a manner consistent with this policy, the employee, market vendor, or shopper is required to report the situation to the manager that has been designated to receive such complaints: Kate Parker, Executive Director at (504) 861-4485 and kate@marketumbrella.org.

If an employee, vendor or shopper feels that (s)he is a victim of harassment by the above management member, or (s)he makes a report and the manager either does not respond or does not respond in a manner consistent with this policy, the employee is required to report the situation to the President of the marketumbrella.org Board of Directors by mail to 200 Broadway, Suite 107, New Orleans, LA 70118.

Discrimination and sexual harassment in the market or any other marketumbrella.org operating space will not be tolerated. Violations of this policy may result in disciplinary action, up to and including permanent removal from the market or a request to leave the marketumbrella.org operating premises. There will be no adverse action taken against anyone who report violations of this policy in good faith or participate in the investigation of such violations.

Anyone who feels that (s)he is a victim of sexual harassment, discrimination or any other unfair treatment should immediately report such actions in accordance with the following procedure. All complaints will be promptly and thoroughly investigated as confidentially as possible.

  1. Anyone who believes that (s)he is a victim of sexual harassment, discrimination or has been retaliated against for complaining of sexual harassment or discrimination, should report the situation immediately to the following member of management who have been designated to receive such complaints: Associate Director at (504) 861-4488 or markets@marketumbrella.org.
  2. The organization will investigate every reported incident immediately. Any employee, supervisor, market shopper, market vendor or agent of the organization who has been found to have violated this policy may be subject to appropriate disciplinary action, up to and including immediate discharge or permanent removal from the market or participation in any other marketumbrella.org event or activity.
  3. The organization will conduct all investigations in a discreet manner. The organization recognizes that every investigation requires a determination based on all the facts in the matter. We also recognize the serious impact a false accusation can have. We trust that all employees, market vendors and shoppers will continue to act responsibly.
  4. The reporting person and anyone participating in any investigation under this policy have the organization's assurance that no reprisals will be taken as a result of a sexual harassment or discrimination complaint. It is our policy to encourage discussion of the matter, to help protect others from being subjected to similar inappropriate behavior.
